Website Terms 

1 Introduction 

1.1 These Terms and Conditions (these “Terms”) apply to the competitions (the “Competitions”) offered via our Website located at Macs Giveaways (the “Website”). 

1.2 The Competitions are operated and made available by MAC’S GIVEAWAYS LIMITED, a company incorporated under the laws of Scotland with company number SC860612, whose registered office is at Elm House, Cradlehall Business Park, Inverness, Scotland, IV2 5GH (“we”, “us”, “our”). 

2 These Terms 

2.1 You should read these Terms carefully before entering the Competitions, as they create binding legal obligations upon you. If you do not understand any part of them, please let us know using the contact details set out below. 

2.2 By entering our Competitions you agree to be bound by these Terms. If you do not agree with or accept any of these Terms, you should refrain from entering the Competitions. 

2.3 Please note that we may update our Terms from time to time, so if you wish to enter a Competition please check these Terms to ascertain the then current version of these Terms. The Terms that shall apply to your entry to our Competitions will be the version that was current at the date of your entry.

3.2 We will endeavour to respond to you promptly. Please note that our contact facilities are monitored only during the hours of 0900 to 1700 (excluding weekends and public and bank holidays in Scotland). 

3.3 Please also note that we may keep a record of correspondence with you to enable us to properly manage our Competitions, to deal with your query, and for quality and training purposes. 

4 Using our Website 

4.1 Our Competitions consist of draws. Where you enter a Competition, your entry will be grouped together with other entries made for that Competition. 

4.2 We will then randomly draw a winner for that Competition. The winner shall then be allocated the Prize relating to the Competition as set out on our Website (the “Prize”). 

 4.3 There is no guarantee that by entering a Competition you will win any Prize. Our decision as to the winners of Prizes is final. 

4.4 Our Competitions may be entered via: 

4.4.1 a free postal entry, which must be sent to the address set out for that Competition; 

4.4.2 where stated upon our Website, either (or both) of a free or paid online entry, which must be made via our Website; 

4.4.3 where stated upon our Website, a free telephone entry which may be made via the telephone number set out for that Competition. 

4.5 Our Competitions are open to persons over eighteen (18) years old and who are resident in the UK only. If you are under eighteen (18) or not resident in the UK, please do not enter our Competitions. 

4.6 If you access our Competitions from locations outside the UK, you are responsible for compliance with local laws which relate to the Competitions, where they are applicable. 

4.7 Further, in the event that you enter our Competitions from outside the UK, or you are under eighteen (18), or otherwise breach these Terms, any entry will be invalid and we may withhold from remitting any Prize to you, and/or retain and not refund any payment for entry made by you (an “Entry Payment”), in compensation for our time and expense dealing with the matter. 

4.8 In entering our Competitions, you must not use any technology designed to conceal your location, including VPN services, proxy servers or similar tools. 

4.9 You agree that you are solely responsible for all costs and expenses you may incur in relation to your entry to our Competitions, including the costs of any telecommunications service utilised to access our Website. 

4.10 Whilst we will try to make sure our Website is available and functions properly at all times, we do not guarantee that our Website will be available all the time, or at any particular time, that our Website will function properly, or that any functionality upon our Website will be available at all, or any, times. Further, we may suspend or terminate operation of the Website at any time as we see fit. 

4.11 Where you submit any information to us, such information must be true, accurate, complete and correct. 

4.12 We may use this information to allow us to operate the Competitions, to monitor your engagement with the Competitions, and to verify information concerning you, including for the purposes of ensuring compliance with applicable laws, to prevent fraud, and to protect the rights, property and safety of ourselves and other persons.

4.14 Where the Website allows you to login you must keep your password and other account details confidential. Please let us know immediately in the case that you suspect or know your password or other details have become known to any other person. If you give your login details to any person, you are liable for any use they make of our Website via that login. 

4.15 We seek to make the Website as accessible as possible. If you have any difficulties using our Website, please contact us using the contact means set out above and/or use the accessibility tools available through the device via which you access our Website. 

4.16 If you wish to have a copy of these Terms for your records, or require a copy of these Terms in another language, please contact us using the contact means set out above, and we will send you a copy. 

4.17 You are permitted to use the Website and enter the Competitions for personal and noncommercial purposes only, and subject always to these Terms. 

5 Entry Payments 

5.1 Our Website sets out the Competitions you may enter, and the Entry Payments which may be required, the postal entry address and telephone number for entry, and the available Prizes for the Competitions. 

5.2 Competitions will be available for entry during defined periods only, the details of which shall be set out on our Website (“Entry Periods”). You will not be able to enter a Competition outside of its Entry Period. If you are entering a Competition via the postal entry, please send this in good time prior to the end of the relevant Entry Period and within sufficient time for entries to be generated. Entries received after the end of the Entry Period will not be included in the relevant Competition. 

5.3 Please exercise care when entering Competitions. Once you enter a Competition entry is final and may not be cancelled, and any Entry Payment made in relation to that entry may not be refunded. Whilst we may acknowledge entries to Competitions, we do not undertake to do so in all events. Please see our refund policy for more information. 

5.4 Where you wish to enter a Competition via post, please send a letter or postcard to the address set out for that Competition. Your postal entry must be hand written and clearly state your full name, postal address, date of birth, email address, telephone number, and the exact name of the Competition you wish to enter, including the website URL in full, for example: https://macs-giveaways.co.uk/competition/12ft-x-8ft-thorpe-trampoline/ –  together with any other information stated as required for entry to that Competition upon our Website. Postal entries must be sent by ordinary first or second class post and must not include any payment. Printed labels, photocopies, typewritten postcards, or entries enclosed in any form of envelope or outer packaging will be deemed strictly invalid and immediately destroyed.

5.5 Where an entry limit applies to a Competition, that limit applies across all entry routes combined. 

5.6 The operation of all Competitions is subject to the applicable laws of the United Kingdom. If we are prevented from operating any Competition, taking or returning any Entry Payment, remitting any Prize, accepting or processing any entry, or from allowing you to participate in any Competition, then we may withhold from operating the Competition, taking or returning any Entry Payment, remitting the Prize or allowing you to participate in the Competition (as applicable) without liability to you. 

5.7 Macs Giveaways accepts no responsibility for delays, loss, or non-delivery by Royal Mail.

6 Entry Payments 

6.1 Where you are making an Entry Payment to us, we will accept the following debit cards and methods for making Payments: Visa Debit, Debit Mastercard (our “Payment Methods”). We do not accept Payments by credit card, cash, or any other means. 

6.2 Where an Entry Payment is made, your Payment Method will be charged at any time after you submit your request to make the Entry Payment. Please ensure you have sufficient funds to meet any Entry Payment due to us. If we do not receive an Entry Payment or the Entry Payment is subsequently reversed or cancelled, your entry to the Competition will not be made. If this takes place after a Prize has been allocated to you, you must return the Prize to us. 

6.3 Entry Payments to us may need to be authorised by the relevant Payment Method issuer. 6.4 Within a reasonable period following the end of an Entry Period, we will confirm whether you have won a Prize. We will not notify unsuccessful entrants. Winners are determined using a random selection process which does not favour paid entries over free entries. Our determination of winners is final. 7 Prizes 

7.1 All winners will be notified on winning on how the prize can be collected or delivered as this will depend on the prize and location. All terms and conditions must be read by all participants before entering to ensure they understand this. All age restrictions must also be adhered to.

7.2 Where you have been allocated a Prize, we may be required under applicable law to report this to relevant authorities, and/or to withhold from remitting part of or the whole of that Prize to you. We may take such action in this respect as we determine in our opinion may be required. Our judgement in such matters shall be final. Where we take any such action, we shall let you know.

8 Consumer protection 

8.1 We may from time to time and at our sole discretion implement limits on the number of times you may enter our Competitions. 

8.2 We may request (and you must provide) information on your financial standing, so that we may identify and protect potentially financially vulnerable customers. 

8.3 We may implement such other restrictions concerning our Competitions, and/or their operation, as we determine in our sole discretion to be prudent or sensible, or which may be required pursuant to applicable law or likely changes to applicable law. 

9 Restrictions on Misuse 

9.1 You must not misuse or abuse our Competitions. The following are examples of misuse and abuse: 

9.1.1 using the Competitions for the laundering of proceeds of crime, to obscure or avoid detection or identification of funds received or held by you, to avoid the payment of taxes, or for any other purpose which may be unlawful or improper; 

9.1.2 entering the Competitions for or on behalf of another person; 

9.1.3 entering Competitions using a Payment Method which is not in your own name; 9.1.4 causing the operation of the Competitions to be jeopardised or impaired; 

9.1.5 accessing, or to attempt to access, the accounts or information of others; 

9.1.6 using the Competitions in conjunction with any effort to penetrate or attempt to penetrate or breach anyone’s security measures, computer software, hardware, electronic communication systems, or telecommunications systems; 

9.1.7 using the Competitions to collect, or attempt to collect, personal information about third parties without their knowledge or consent; 

9.1.8 engaging in “screen scraping,” “database scraping,” or any other activity with the purpose of obtaining lists of entrants or other data; 

9.1.9 using the Competitions to assist with any activity which adversely affects the ability of other people or systems to use the services or the internet generally, including, without limitation, flooding and hacking; or 9.1.10 impersonating any person or entity or using a false name that you are not authorised to use. 

9.2 Further, in the conduct of your activities you must not mention or refer to the Competitions or use the availability of the Competitions in any way: 

9.2.1 that causes nuisance; 

9.2.2 in conjunction with any defamatory, offensive, or obscene material, or activities which would cause offence to others on grounds of race, religion, sexual orientation or otherwise; 

9.2.3 in conjunction with any harm or harassment or attempt to harm or harass other people (including children) in any way; 

9.2.4 in conjunction with any material that threatens or encourages bodily harm or the destruction of property, or the conduct of criminal offences or any activity which may give rise to civil liability; 

9.2.5 in conjunction with material which infringes the copyright, trademark, patent, trade secret, privacy, right of publicity, or other intellectual property or rights of any other party; 

9.2.6 in conjunction with any unsolicited advertising, promotional or marketing material; or 

9.2.7 in conjunction with any false, misleading, deceptive, or fraudulent material or activities, including chain letters or pyramid schemes or the like. 

10 Security 

10.1 We may apply security measures and restrictions to our Competitions. You agree not to tamper with or try to circumvent, avoid or negate such security measures or restrictions, or ask or help any other person to do so, including by the submission of false information, or using means which obscure the identity of the devices used to access or the persons accessing our Competitions, such as using VPN services or the TOR browsers. Our Website contains important notices (including intellectual property notices) including that contained in any digital rights or other security technology embedded or contained within the Website. You must not tamper with or attempt to remove any of these notices. 

10.2 Communication via means of telecommunications, including the internet, post and/or telephone is not secure. While we try to make sure that the facilities we use to operate the Competitions are secure, we cannot guarantee the security of any information that you supply to us and therefore we cannot guarantee that it will remain confidential, for example during its transmission to us. 

10.3 Please note that we use third party payment service providers to allow Entry Payments to be made to us. These services are PCI DSS compliant (see http://www.pcisecuritystandards.org), and we do not have access to your Payment Method information. 

10.4 In the absence of negligence on our part, or any failure by us to comply with these Terms, or breach by us of our duties under applicable laws, we will not be responsible or liable to you for any loss that you may suffer if a third party gains unauthorised access to any information (including any Payment Method information) that you submit to us (or our Payment Method service provider). Further, we recommend that you have in place up to date antivirus and personal firewall software when accessing and using our Website. 

11 Information 

11.1 When you submit information to us, you grant us the right to use that information in connection with our operation of the Competitions. This includes storing that information. We may permit other people to do this on our behalf. These rights shall be free and irrevocable, and shall exist perpetually. This does not affect your rights under laws relating to personal data. However, where any personal data is contained in that information, you consent, and must have any other identified person’s consent, to submit that information to us and to allow us to use that information as mentioned above. 

11.2 The Competition, our Website, and all intellectual property relating to the foregoing is owned by us and/or our licensors (as applicable). Intellectual property includes the copyright in our Website and its code, our trade marks, and those of other people, design rights, for example in our user interfaces, database rights, and all other intellectual property or rights of any kind, and whether or not they are registered or unregistered, even if it were possible to register them (and we have not progressed any such registration). We and our licensors reserve all of our and their rights. This means, for example, that we (and they) remain owners of the intellectual property and remain free to use it as we (and they) see fit. 

11.3 You have the right to access and use our Website and enter the Competitions, subject always to these Terms. Nothing in these Terms or otherwise grants you any other right, title or interest in or to the Website or the Competitions. 

11.4 If you think any part of our Website or the Competitions, infringes your rights, please contact us using the means set out above. When contacting us please provide: 

11.4.1 your address, telephone number, and email address; 

11.4.2 description of the rights that you claim have been infringed; 

11.4.3 a description of the alleged infringing activity; 

11.4.4 a statement by you that you have a good faith belief that infringing activity is not authorised by you, the rights owner, its agent, or the law; and 

11.4.5 a statement by you, made under penalty of perjury, that the information is accurate and that you are the rights owner or authorised to act on the rights owner’s behalf. 

12 Liability 

12.1 Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury), we are not legally responsible for any losses that were not foreseeable when you accessed our Website or entered the Competitions, or that were not caused by any breach of these Terms or any duty on our part. 

12.2 Our Website and our Competitions are provided “as is,” and your use and entry are at your own risk. 

12.3 We exclude to the fullest extent permitted by law, any and all express and implied warranties and guarantees. 

12.4 What we will do, and what we say we won’t do, what we will and will not guarantee, and what we recommend or require you to do, in these Terms and in information set out upon our Website, is therefore very important. Please read these Terms and any such information carefully and let us know if you don’t understand any part of it. 

12.5 We shall have no liability to you for any breach of these Terms caused by any event or circumstance beyond our reasonable control including, but not limited to, strikes, lock-outs or other industrial disputes; breakdown of systems or network access; or flood, fire, explosion or accident. 

12.6 We are not responsible for any postal delays, losses or failures, or for any failure of telecommunications, internet services, computer systems or other technology outside our reasonable control, including where such issues affect the submission, receipt or processing of entries, the communication of results, or the remittance of any Prize. 

12.7 Further, no one other than a party to these Terms has any right to enforce any of these Terms. Additional terms The Website may contain hyperlinks or references to third party websites or Websites. Any such hyperlinks or references are provided for your convenience only. We do not operate these third-party websites and accept no responsibility for any content, material or information contained in them or for their operation. The display of any hyperlink and reference does not mean that we endorse that third party’s website, Website, products or services. Your use of a third-party site or Website will be governed by the terms and conditions of that third party website or Website, not these Terms. 

13 Your rights 

You have certain legal rights when entering the Competitions. These are also known as ‘statutory rights’ as they are derived from laws such as the Consumer Rights Act 2015. For more information upon these rights please consult your local Citizens Advice Bureau or an appropriately qualified and experienced lawyer. Please note that you do not have a right to cancel any contract with us regarding an entry to any Competition at your discretion and without cause pursuant to The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or otherwise. 

14 Disputes and governing law 

14.1 We will try to resolve any disputes with you quickly and efficiently. 

14.2 If you are unhappy with us, please contact us as soon as possible. 

14.3 If you and we cannot resolve a dispute using our complaint handling procedure, we will let you know that we cannot settle the dispute with you. 

14.4 If you want to take court proceedings, the relevant courts of the United Kingdom will have jurisdiction in relation to these Terms, and relevant United Kingdom law will apply to these Terms.

16 We are not obliged to use alternative dispute resolution and do not agree to participate in alternative dispute resolution proceedings. 

Live Dog Races & Winner Selection

Where stated on the competition page or promotional material, winners may be selected using a live virtual dog race.

1. Each eligible entry will be allocated one duck (or the appropriate number of ducks where multiple entries are permitted) and entered into the live virtual duck race.
2. The dog race is used solely as a random method of selecting a winner. It is provided for entertainment and transparency only and does not involve any skill or influence from participants.
3. The winner will be the entrant whose allocated duck finishes in first place.
4. Only entries that comply with these Terms and Conditions and any competition-specific rules will be included in the dog race.
5. Live dog races may be broadcast via the Company’s social media channels or other platforms. Where a live broadcast is unavailable or interrupted due to technical issues, the Company reserves the right to complete the draw using the same random selection method and publish the result afterwards.
6. The outcome of the dog race, once verified by the Company, will be final, except in the case of an administrative or technical error.
7. By entering a competition that uses a live virtual dog race, entrants agree to this method of winner selection.

Instant Win Prizes

1. Certain Competitions may include Instant Win prizes in addition to the main Competition prize. Where applicable, the available Instant Win prizes will be displayed on the relevant Competition page.

2. An entry which wins an Instant Win prize will remain valid for the main Competition draw unless expressly stated otherwise on the Competition page.

3. Instant Win prizes are separate from the main Competition prize. References to the total value of Instant Wins available refer to the combined value of the Instant Win prize pool and do not mean that the winner of the main prize will also receive those prizes.

4. Where a cash alternative is offered for an Instant Win prize, the applicable amount will be the cash alternative advertised for that specific prize.

5. Instant Win winners may be required to verify their identity and eligibility before a prize or cash alternative is released.

6. Instant Win prizes are subject to the same eligibility requirements contained within these Terms and Conditions.

Site Credit

1. Site credit may be awarded as a prize, promotional reward, refund promotion or other offer operated by Macs Giveaways.

2. Site credit has no cash value, cannot be withdrawn or exchanged for cash and is non-transferable.

3. Site credit may only be used towards eligible purchases or Competition entries on the Macs Giveaways website.

4. Where site credit is issued as part of a specific promotion, any additional conditions applicable to that promotion will be clearly stated at the time of the offer.

 

5. Any applicable expiry date will be communicated when the site credit is issued. Unused credit remaining after an applicable expiry date may be removed from the customer’s account.

Entry Prizes & Mini Draws

1. Macs Giveaways may operate separate Competitions or promotional draws where the prize consists of a specified number of entries into another active Macs Giveaways Competition.

2. The number of entries being awarded and the Competition into which those entries will be placed will be clearly stated on the relevant Competition or promotional page.

3. Once awarded, these entries will be entered into the specified Competition and will have the same opportunity to win as other valid entries in that Competition.

4. Winning entries into another Competition does not guarantee a prize in that Competition. The winner will receive only the stated number of entries.

5. Unless expressly advertised otherwise, entry prizes have no cash value and cannot be exchanged for cash, site credit or transferred to another Competition.

6. Any separate paid Mini Draw will be subject to the applicable eligibility, entry and free postal entry provisions contained within these Terms and Conditions.
